Workplace Violence & Harassment

Smugglers' Notch is committed to preventing workplace violence and to maintaining a safe work environment, and has adopted the following guidelines to deal with intimidation, harassment and threats of, or actual, violence.

All employees should be treated with courtesy and respect at all times. Employees are expected to refrain from fighting, "horseplay," or other conduct that may be dangerous to others. Smugglers' Notch Resort prohibits firearms, weapons, dangerous/hazardous devices or substances from the premises of Smugglers' Notch without prior authorization.

Conduct that threatens, intimidates, or coerces another employee, a customer, or a member of the public at any time will not be tolerated. This prohibition includes all acts of harassment, including harassment based on an individual's sex, race, age, or any characteristic protected by federal, state, or local law.

All threats of, or actual, violence, both direct and indirect, should be reported as soon as possible to your immediate Supervisor, Security or any other member of management. Smugglers' Notch will promptly and thoroughly investigate all reports, and the identity of the individual making the report will be protected as much as is practical. Anyone determined to be responsible for violating these prohibitions will be disciplined up to and including termination of employment.

Additionally, it is against the policy of Smugglers' Notch Resort, and illegal under state and federal law, for any employee, male or female, to sexually harass another employee. Sexual harassment is a form of sex discrimination and means of unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:

  • Sexual harassment occurs in the eyes of the subject of the harassment;
  • Submission to that conduct is made either explicitly or implicitly a term or condition of employment;
  • Submission to or rejection of such conduct by an individual is used as a component of the basis for employment decisions affecting that individual; or
  • The conduct has the purpose or effect of substantially interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment.
